DIEHL CASE AGAINST WILLIAM COOK DEFENCE THROWN OUT

Diehl Remscheid GmbH, the German tank track manufacturer, has been defeated by William Cook Defence in the Belgian Court of Commerce.

Diehl, supplier of tank tracks to many European armies, had brought a lawsuit against William Cook Defence and its Belgian based marketing partner, Varec N.V, which would have had the effect of preventing the British and Belgian companies from offering competing track products for the Leopard 1 and AS 90 Armoured Fighting Vehicles.

In a detailed judgement, Court Vice-President Jean-Marie Le Haye dismissed all Diehl's claims and awarded costs against them.

Said William Cook Defence's Managing Director Phil Kite, "We are delighted to have defeated Diehl's ill-founded action and can now set about repairing the damage their lawsuit has done to our business in the UK and Europe.�

Commenting on the matter, William Cook Group Chairman Andrew Cook said "Diehl were very foolish to take this action. I trust they will think twice before taking us on again�.
